When it comes to railroad eminent domain usage, it's not a question of if they will get the property required for rail transportation operations, but rather fair compensation .

Washington State law delegates the right of railroads to take property through eminent domain use , which have long been considered a public use .

The Railway Business Car Services/RBCS is a Class II Railroads as defined by the Surface Transportation Board, is a railroad with an annual operating revenue of less than $20 million.

THE RBCS operates as defined by Shortline Railroad which is entitled to all legal status as any Railroad Companyis an entity that operates a railroad track and/or Train trains. Such a company can either be Private or Public . Some railway companies operate trains, private railroad cars or passenger cars and the track siding.

The RBCS will enter in to contract with Amtrak Private Rail Operations to provide movement for RBCS passenger railcar Fleet under National Railroad Passenger Corporation Authority.

This will include working with Burlington Northern Santa Fe Railway to developing a new rail-served facility can be challenging, especially when it comes to navigating through all the necessary processes. RBCS can rely on BNSF to help guide RBCS through all aspects of 3 phases to developing a new site, including evaluating and selecting the best options for RBCS

    The Intent of Seattle Railway Business Car Services/Seattle RBCS, is to introduce the private railcar services to the Pacific Northwest by offering private rail coach transportation service for:

  • Siding Services for National Private Passenger Coach and Passenger Train Industry
       for:
  • Interchange Siding and Extended Stay Passenger Coach Facility Support Services.

    The Proposal is for Seattle Railway Business Car Service to acquire a fleet of 10 or more passenger coach of various type for operations in Amtrak National Route Services, including connecting routing to Canada And Mexico Rail Services. This includes connecting to rail line community route over existing operating rail to shorline railroad.

    The Business Plan of Seattle RBCS is to secure facility property in Seattle, Washington, within "Passenger Railroad Industrial Complex" that would provide proficient and reasonable access to King Street Station and Amtrak Maintenance Facility for interchange and connecting yard services.

    Property of Necessity Located At: 1750 Occidental Avenue South, Seattle, Washington, within the SoDo District, existing Seattle Railroad Passenger Service Yard Complex is the most proficient site for Railway Business Car Services Operations.

    This Site Offers Most Proficient & Convenient Switching Operations for Amtrak Terminal Switching Convenience connecting private passenger rail traffic to:

  • Empire Builder Tariff Route,
  • Coast Starlight Tariff Route,
  • Non-Amtrak-BNSF Tariff Rail Line Communities,
  • Amtrak-BNSF-Shortline Railroad Tariff Connecting Rail Line Communities.

    Loss of Proficiency and Convenience of Rail Switching Operation or deviate from the RBCS Plan, would devastate the capacity to provide interchange or connecting services to Amtrak. As the Seattle Railroad Industrial Complex near King Street Station and South Holgate Street would improve Amtrak Switching capacity to be more expedient.     King Street Station Terminal Switching Performance for private passenger coach can take of to 20 minutes or more per coach. Current Amtrak Maintenance Yard is not suitable for private passenger coach switching and that limited track siding exist in such Seattle Coach Yard.

    Current Private Coach Passenger's are force to egress from a busy dangerous coach maintenance yard that was design for industrial operations, not passenger safety, nor comfort. The RBCS Facility would provide siding switching and a place for private car traveler's to relax in RBCS Lounge, while the coach is being serviced. During departure switching time the coach would be positioned for Amtrak Switching to destination train.

  • Joint ventures that include at least one railroad, and
  • Limited option freight shippers who intend to construct a new rail connection.

    The RRIF program was established by the "Transportation Equity Act for the 21st Century" and amended by the "Safe Accountable, Flexible and Efficient Transportation Equity Act": a Legacy for Users.

    Under RRIF program the FRA Administrator is authorized to provide direct loans and loan guarantees up to $35.0 billion. Up to $7.0 billion is reserved for projects benefiting freight railroads other than Class I carriers.

    The rail industry economist predict that all passenger rail activity could double by the 2050, thus the need to build an innovative passenger rail network is neccessary to compete globally.

    When it comes to passenger railroads, they are a best method of transportation, providing onboard and station services and cleaner form of transportation than any other ground alternative. The U.S. passenger railroads can moved 13.5 passenger (150lbs Per Passenger Ton Weight) an average of 457mpg of fuel, are better for the environment and help alleviate highway congestion.

    The Private Passenger Railcar Industry provides Amtrak with about $2.5M in revenue in fiscal 2010, and the Amtrak Private Railcar Service operates at a profit-revenue that exceeded costs by about $660,000 in fiscal 2010.

    Amtrak's Business Plan is to operate as a for-profit-industry and providing private passenger railcar hauling services is a source of revenue, although this operational services is a tiny fraction of Amtrak’s overall $2.5 billion in revenue.

    Amtrak fosters the opportunity to serve America’s "80 For Hire Railcars" (not including personal use railcar or corporate trains "Not For Hire Railcars") Private Passenger Railcar Industry, as the American Railroad Industry has a long history of partnership with the Private PassengerRail carr Services.

    Our Nations rail system has the capacity to support more private passenger railcar services, as the current 80 private railcar could never support the national rail transportation market demand.

    Private Railcar Charter Rates can start at $2,500per-person-accommodation capacity to $8,000per-day-charter, depending on guest requirements and mileage itinerary

    The goals of the Railway Business Car Services/RBCS are:

    • Improve existing Amtrak intercity operations and rail line community experience;
    • Purchase railcars made in America and utilize local labor and materials;
    • Increase rail line communities mobility by creating private railcar access;
    • Improve private passenger railcar support, supply and maintence facilities; and
    • Invest in rail line communities by planning and participating in events for tourism opportunities of our citizens.

    RBCS cannot accomplish these goals alone. It is critical that private passenger railcar industry continue growth planning & development to maintain a strong rail line community presence and working relationships with Class I operating railroads, shortline railways, regional rail networks toward interactional partnerships, state rail transportation agencies and associations. States have demonstrated that constructing rail projects, create jobs, and prove how successfully they can invest taxpayer dollars. The RBCS projects also requires congressional, state agencies and investors to join in a partnership with RBCS as relevant private passenger railcar stakeholder. The RBCS will seek additional funding resources to impact a long-term rail line community transportation services with predictable project planning to acquire funding source of federal matching funds and private investment opportunities for investors.

    RAILWAY BUSINESS CAR SERVICE/RBCS PROJECT FINANCING will require federal and state assistance (including private investor funding) assistance and will not be based upon grants and subsidies but rather be facilitated by an existing loan program under the Railroad Rehabilitation and Improvement Financing/RRIF Program. This Railroad Improvement Program does authorizes the Federal Railroad Administration/FRA to lend funds to railway projects like the Railway Business Car Services Rail Projects that allows expanding the nation’s intercity rail transportation infrastructure.

    FRA Passenger Rail Financing Programs offer the flexibility toward's the private passenger industry and related rail line community investment. In applying for RRIF Loan, the Secretary of Transportation has broad discretion to use funding resources to implement and support projects that exemplify the goals of the FRA Passenger Intercity Programs under RRIF/Passenger Rail Investment and Improvement Act of 2008/PRIIA program.

    RBCS is preparing to submitted its RRIF loan application, which is currently published for review prior to submission before the FRA’s Independent Financial Advisor, loan evaluation process can take 19 months to review project. Current the RBSC has advise the RRIF Loan Committee, that a conflict exists in Seattle, Washington, that require issues to be resolved before submitting application.

    The RBCS Private Railcar Facility Project in Seattle, has been planned to be financed through a combination of private capital and RRIF loan funding process. The RBCS Project Financing Demonstration will be repaid the loan over 35 years including interest.

    Railroad Rehabilitation and Improvement Financing/RRIF Program is ideal for RBCS Project because it is the only private passenger railcar and operational rail project

    in America positioned to jump-start the private passenger railcar industry
    that will impact rail line community intercity public benefits, produce tangible demonstration that benefits our national rail achievements, goals and priorities to:

    1). Providing jobs and stimulate rail line community economy,
    2). Enhancing the environmental strategies toward global warming,
    3). Improving intercity regional rail economic centers,
    4). Offering a safe and efficient rail transportation choice,

Sites east and west posed specific problems with accessing/switching to Amtrak Railroad Business Passenger Yard Industrial Complex/King Street Station. BNSF also objected to potential sites to east and west of Amtrak Railroad Business Passenger Yard Industrial Complex

    Currently, Private Passenger Railcars, do have the option to use the limited 2 side track at King Street Station, which are share with BNSF Corporate Train, Sound Transit Communiter Trains, WSDOT Talgo/Cascade Coachs and Amtrak Special Charter Services.

    King Street Station Siding for Private Railcar Traffic, does become congested and competitive for siding, in which case Interchange Coach are sided in Amtrak/Sound Transit Maintenance Yard, as there is just limited space.

    In all current siding locations available to private railcar passenger, does pose a "Public Safety Risk", do to lack of services and lack of proper facility's.

    As City Seattle Government owns King Street Station, thus having no concern for private coach passenger, the Seattle City Council also show no interest in public safety toward such coach passenger (Testimony by Mr Alloin, to City Council). It as been observed that families & children traveling in private coach use the busy traffic at King Street Station for a playground and Corporate Railroad Trains and Coaches use King Street Station for repairs, coach cleaning and supply deliveries.

    Public Safety for travel private coach passenger who are unable to use King Street Station, do to congestive traffic, no other alterative but to be sided in Amtrak "Busy" Coach Maintenance Yard Traffic. Again, passenger, families & Children have to egress to South Holgate Street or Walk to King Street Station via the Busy Yard Traffic and use the Train Yard as a playground.

  • Promote Economic Development:
    The Railway Business Car Services will provide economic development opportunities to Seattle and all rail line Communities in Washington. The RBCS will increase employment opportunity growth and increases business and commerce industry growth in the region. This includes domestic tourism to increase, as 30,000,000 current rail riderships have interest in our private rail services and provide current private rail passenger the opportunity to use RBCS while in Washington State or Pacific Northwest, which will increase RBCS competitiveness by:
  • Rationalization output to get rid of high cost out of State Private Railcar Services.
  • Relocating private rail coaches in Seattle to lower cost of operations.
  • Process innovation in travel tourism industry.
  • Providing a private rail product of innovation services and destination packages.

    It is expected, that RBCS will attract new rail patrons do to its availability in region for traffic between Oregon, California and Montana will experience increased traffic.

    This will include static railcar italicization, for the general public to experience special occasion onboard one of our coaches.

    Globalization and trade liberalization coupled with rapid advances in information and communications technology have resulted in an unprecedented intensification of market competition worldwide.

    The RBCS International tourism Trade must be about improving and continuously improving private railcar competitiveness; all our strategies, plans, programs, and policies must be directed toward raising our productivity.

    The RBCS private railroad passenger services, will provide more rail transportation opportunities for international tourism trade to Washington, by offering international visiting guest the opportunity to explore rail travel.

    RBCS will provide rail travel services to Canada and Mexico, for both domestic and international tourism.

  • Preserve or Enhance Rail Service to Small Communities or Rural Areas:
    The Railway Business Car Services, will provide rail line communities the opportunity to participate in domestic and international tourism, including event transportation service to rail line community attractions and events.

    The RBCS will impact Amtrak CNOC private passenger car traffic revenues services. The Railway Business Car Services will also increase traffic over non-Amtrak Routes, such as shortlines and local traffic of long haul railroad. It is expected that rail line community shortline railroad, will great experience revenue traffic, thus benefiting the shortline and terminal railroad operations.

    The RBCS expects to lower its operating cost by the application of new and emerging energy saving applied technology to coach operations and facility environmental management.

  • Permit Use of Higher Load Rail Cars:
    RCBCS will use higher occupancy coach, where such equipment can operate over Amtrak intercity services. However, in most cases standard pullman coach have greatest opportunity to travel to rail line community, do to restriction is height over some lines, where bridge and tunnels have not been renovated for higher occupancy coach.

  • The role of private rail transportation services is to increasing the state’s economic competitiveness;

  • Projected increases in population and the impact of this population will create demand for private rail passenger services;

  • Ensuring business and tourism demand for passenger rail system mobility within private rail industry;

  • Enhancement of all sectors of rail system can support the critical roles the private passenger rail industry provides  in emergency preparedness;

  • The need to maintain rail infrastructure and corridors by planning for the preservation;

  • Insure rights of way access for for private rail industry for future appropriate use;

  • The physical, environmental, and financial constraints associated with adding capacity to the transportation system;

  • The balance between adding capacity to the transportation system while supporting community livability goals such as compact growth and transit-oriented development;

  • The role that private rail passenger industry can play in support of our national environmental initiatives, including the reduction of greenhouse gas emissions, increased energy efficiency, and land conservation.

    Railway Business Car Services/RBCS Plan includes a statewide vision for Washington State's rail transportation system that recognizes the vital role that private railcar passenger industry will play as part of a multimodal, interconnected transportation system if Washington State is to be well positioned to compete in global trade and tourism opportunities.

    The Railway Business Car Services/RBCS Vision also lays the foundation for rail investments to support rail line community values, improve the quality of life for Washington State's residents and visitors, and ensures the sustain ability of the state’s environment and natural resources. The Private Rail Passenger Industry has participated in several Amtrak and Operating Museum key events that have lead to a rebirth of private passenger railway services nationally and reviews the purpose and role of the Amtrak Rail System Plan. Furthermore, the RBCS purpose of the Private Rail Passenger Services is towards key societal and demographic trends that private rail passenger are part of growing Amtrak Operations that utilize private railcars.

    The Railway Business Car Services/RBCS rail service roles and responsibilities of privately–owned rail companies to provide rail service in Washington State and nationally. The goals, objectives, and strategies of this plan which together form a policy framework for the FRA investment of resources in our rail system in partnership with private rail interests and other public entities.

    The Railway Business Car Services/RBCS Policy Framework is organized around the five goals as follows:

    Safety and Security

    The Railway Business Car Services/RBCS should identify and support rail safety improvements and coordinate with appropriate rail industry partners to identify and implement security and emergency response plans;

    Quality of Life and Environmental Stewardship

    The Railway Business Car Services/RBCS Rail and land use planning should be integrated at the state, regional, and local levels. Further, the environmental benefits of private passenger rail services should be evaluated and transportation and environmental decisions should be integrated into the statewide, regional, and local planning processes.

    Maintenance and Preservation

    The Railway Business Car Services/RBCS Maintenance and preservation of private passenger rail service infrastructure and modernization of the private passenger rail system will remain a high priority.

    Mobility and Economic Competitiveness

    Investments in Railway Business Car Services/RBCS private passenger rail system should support economic growth. Railway Business Car Services/RBCS will invest in rail system capacity improvements towards the interstate and intrastate movement of passengers and enhance national/international tourism, including business/commerce opportunities for public benefit can be demonstrated. Railway Business Car Services/RBCS capacity should be preserved for future needs, including the evaluation of all low traffic rail lines, shortlines rail line community traffic, along with abandoned rail corridors for future rail use.

    Sustainable Investments

    Railway Business Car Services/RBCS Public Awareness of the need for state and regional investments in private passenger rail is an important component of Railway Business Car Services/RBCS goal to become increasingly competitive economically and its ability to keep pace with investments in private passenger passenger rail services occurring elsewhere in the nation. Opportunities for funding rail projects should be aggressively pursued in cooperation with leaders at the local, regional, state, and national levels.

    Specifically:

    a). Railway Business Car Services/RBCS should capitalize on opportunities at the local, regional, and state levels to capture federal dollars for rail projects;

    b). New and innovative revenue sources and financial investment tools to fund rail improvements should be identified;

    c). Public-private partnerships should be considered when in the public interest;

    d). Railway Business Car Services/RBCS Rail Plan consists of two elements:

    The Policy Element

    The Railway Business Car Services/RBCS Policy Element, establishes a vision for private passenger rail transportation in Washington State and a policy framework of goals, policies, and strategies to guide future Railway Business Car Services/RBCS rail investments and decisions.

    The Investment Element

    The Railway Business Car Services/RBCS Investment Element will identify an inventory of needs, establish priorities for the investment of federal, state, private funds using the policy framework of the Policy Element, and will set forth future action steps necessary to implement the plan.

    Railway Business Car Services/RBCS Vision of Rail Transportation

    Railway Business Car Services/RBCS plan is for a safe, secure, and efficient private passenger rail service providing mobility, improving quality of life and promoting economic opportunities and environmental sustain ability for Washington State.

    Railway Business Car Services/RBCS plan will provide Washington State residents, visitors, and businesses enjoy improved quality of life, increased economic opportunities and competitiveness, smart growth in and around urban centers, and greater environmental sustain ability. Railway Business Car Services/RBCS plan will contributing significantly to all of these by providing safe, and increasingly seamless, interconnected passenger mobility throughout the Washington State, its regions and in many cases its rail line communities, as well as efficient connections to national and international markets. It does this through thoughtful investment strategies, effective public/private and public/public partnerships,and full integration with other modes of transportation.



    The Rebirth of Private Passenger Railcar Industry

    The history of Private Passenger Railcar Industry spans over 170 years and is intricately part of the rail transportation growth and development. Most of the significant Private Passenger Railcar activities occurred in the first half of the 20th century with the opening of transcontinental railroad gateway linking the United States to the boom in railroad construction.

    Rail Investment activities declined during the second half of the 20th century, due to the construction of the National System of Interstate Defense Highway System which provide a false pretension that the automobile was to be "only preferred choice" for personal passenger mobility movement to established rail line communities.

    In 1980's, and under the Reagan Administration various events occurred to mark the rebirth of railroading, including:

  • The Staggers Rail Act of 1980 deregulated the industry allowing railroads to compete in the transportation marketplace and abandon unprofitable lines;
  • Growing Auto environmental pollution emphasized the need for a renewed role for rail passenger service;
  • Growing highway and airport congestion emphasized the need for a renewed role for rail passenger service;
  • American Association of Private Railcar Owners creating and renewing need for private passenger rail industry;
  • Railroad Passenger Car Alliance creating renewed interest in passenger rail industry;
  • American Train Destination Lines taking a leading development in lobbying/promoting rail services and railroad information;
  • Creation of Railway Missile Defense System;
  • Creation of National Dinning Train Program;
  • Legislation creating the High Speed Rail Transportation Commission (1984);
  • Recent USDOT initiatives to create or expand commuter rail service, regional rail transportation, streetcar transit projects, operating heritage museum excursion, shortines railroad preservation of services, tourist railway improvement.

    Purpose and Role of the Railway Business Car Services/RBCS Plan

    The Railway Business Car Services/RBCS is responsible for developing the Seattle Private Rail Car Facility. According to Amtrak Private Owned Coaches, the private passenger rail industry is to include an identification of National Railroad Passenger Corporation priorities, programs, and funding levels required to meet statewide and national priorities that include private coaches services. The Railway Business Car Services/RBCS Plan must be updated every two years. Further, in recognition of the role that the Railway Business Car Services/RBCS participates in the overall rail passenger transportation system, the plan must be consistent with the Amtrak Rail Transportation Plan that identifies goals, objectives, and strategies to guide national private passenger rail transportation investment decisions.

    In 2008, significant USDOT federal rail legislation was enacted. The legislation is comprised of three Acts:

  • The Rail Safety Improvement Act of 2008
  • The Passenger Rail Investment and Improvement Act of 2008
  • The Clean Railroads Act of 2008.

    This legislation contains a number of provisions related to rail safety in the United States, reauthorizes Amtrak and provides funding authorization to encourage the development of new and improved intercity passenger rail service, and links federal rail grants to state rail plans that comply with certain minimum plan content requirements. Thus, it is important that the Railway Business Car Services/RBCS and Washington State Rail System Planning is compliant with these minimum requirements to ensure state eligibility for certain federal rail funding programs.

    Railway Business Car Services/RBCS Plan is one of unique rail modal planning efforts of the Railway Business Car Services/RBCS; including:

  • Intermodal Passenger Transport 2nd Ave Yard Project
  • Seattle-Whiiter, Alaska Spartan Plan and
  • Seattle Pier 48 Plan
  • Railway Business Car Services/RBCS Washington Private Railcar Services.

    The Railway Business Car Services/RBCS Plan is an integral part of the Intermodal Passenger Transport System. The Washington Railway Business Car Services/RBCS a statewide interconnected system of high-priority transportation hubs, corridors, and connectors within Amtrak, Shortlines, tourist railways, operating historical museum railroads and operating railroad. Recognizing the important economic impact of the rail line community systems, facilities are designated on objective measures of transportation and economic activity.

    The Railway Business Car Services/RBCS Plan also has a close connection to Washington State's economic, environmental, and rail line community planning. Therefore, it is important for the the Railway Business Car Services/RBCS Plan to support the various components of Washington State's statewide planning framework including, but not limited to:

  • Washington State Strategic Plan for Economic Development;
  • Washington State Intermodal System Plan;
  • Washington State Transportation Plan;
  • Washington State Aviation System Plan;
  • Washington State Marine Plan;
  • Washington State Metropolitan Transportation Plans;
  • Washington State Regional Policy Plans;
  • Local government comprehensive plans;
  • Transit development plans;
  • Other rail and freight plans.
